What is the certificate of sexual offenses?

As we have already said, this is a document issued by the Ministry of Justice and is given to people who intend to work with children. This is because, people who wish to work with minors must have specific characteristics, know how to detect and interpret some behaviors and ensure their safety.

This sexual offense certificate states whether or not the person requesting it to work with minors has a criminal record for sexual offenses.

This means, then, that this type of certificate provides truthful information about certain citizens and that this information is recorded in the Central Registry of Sex Offenders.

But what is the Central Registry of Sex Offenders about?

Better known as RCDS, this registry contains all the data of persons who have been convicted of any crime of a sexual nature. Sexual offenses include acts of sexual aggression, harassment, pederasty, exhibitionism, prostitution, sexual provocation and corruption of minors in all areas.

Returning to the RCDS, this refers to the non-public information system that contains the identity, genetic profile, penalties and security measures imposed on persons convicted of committing some of the above-mentioned crimes.

Thanks to this registry it is possible to have all the criminal information from the Registry of Convicted Persons as well as in the Central Registry of Sentences of Criminal Responsibility of Minors related to any crime of a sexual nature.

What do you need to do to apply for a sex offense certificate?

The Treasury has implemented a new technology and created a platform that helps to manage and apply for this permit. However, if you are one of the people who prefer to do it in person, you must request an appointment at your local delegation of the Ministry of Justice.

In case you make the management through the electronic Headquarters, you will find on the main page a series of applications that you can make. Among them is the request for the certificate of sexual offenses. 

After clicking on this option you will find the button “Tramitación online con cl@ve” and then click on “Acceder a la opción DNIe / certificado digital”.

What is the Electronic Headquarters of the Ministry of Justice?

In simple words, it is a system designed to have within reach this type of services under the jurisdiction of this Ministry. Not only is it possible to request a certificate of registration of sexual offenses, but it will also be possible to request a Criminal Record, Birth Certificate, Marriage Certificate, and Death Certificate.

You will also be able to access documents from the General Archive of the Ministry of Justice. In addition, you will be able to find the information you need such as: Frequently Asked Questions about Cl@ve, Disqualification of Property, Mercantile and Movable Property Registries, Regulations, Calendar of non-working days, Complaints and Suggestions, or Personal Data Protection.

3 steps to request the certificate of sexual offenses through the Electronic Headquarters of the Ministry of Justice.

To process your Certificate of Sexual Offenses through the Electronic Headquarters of the Ministry of Justice. You must enter the portal of the same, enter your method of identification and then proceed to fill in the data requested during the process. The application process consists of three steps:

After completing all the steps, you will be shown an identification number that you must save in order to download the document and a link where you can access the certificate.

Finally, after accessing the link you will be able to download the PDF document, once you have successfully completed the above steps.

Who can apply for a sex offense certificate?

The certificate of sexual offenses can be requested by any Natural Person of legal age. Also, any legal entity through its legal representatives.

In case the applicant is another minor or a person with judicially modified capacity, the application must also be made by a legal representative.

If you are a citizen of a member country of the European Union, a request will be made to the Central Authority of the State of your nationality for information on your background, which will be attached to the Spanish certificate that is issued.

When must the Certificate of Sexual Offenses be presented?

The Law on the Legal Protection of Minors states that it must be presented to exercise those professions, trades and activities that involve regular contact with children.

It is also necessary to apply and reapply in the event that you have to join a new company or organization that involves direct contact with minors. 

In the event of a substantial change in the company where you work, such as a change of employer or a change in the contract involving contact with minors, you must present the certificate again.
