Buying a property in Spain: for personal use

After having agreed the ins and outs of the sale contract with the seller of the property, the next step of the process of buying the property will be proceeding to a meeting with a notary. A Spanish notary must approve all the new paperwork in which the new property owner is mentioned.

The key people who must be present for the signing of the paperwork are the seller(s), the buyer(s) and the notary. However, the banker responsible for the account of the seller can also be present in the meeting to validate the cheque.

As for your side, as a buyer, you may bring an interpreter along if you do not speak Spanish and are worried about the language barrier, as well as your manager here in Spain who can help explain the technical side of the sale that you might otherwise ignore.

To complete the sale as a buyer, you must present the following documents:

  • Your NIE as well as a photocopy
  • Your passport and a photocopy
  • The deposit contract
  • Bank cheque
  • Your current address
  • Your future address
  • Marital status: depending on whether you are in the midst of “separate maintenance” or a “communal estate” with your spouse, the nature of the paperwork involved will need to be modified accordingly.

Just like the process of buying a property in Spain for personal use or for an individual, the purchase/sale of a property for a business works in the same way. After having agreed on a contract, the whole procedure terminates before a notary.

So, just as buying a property for personal use, buying a property for a company also requires specific documents such as:

  • The company’s Tax Identification code
  • The company’s written constitution
  • The company manager’s passport and a photocopy
  • The company manager’s NIE and a photocopy
  • The account number of the property buyer
  • The deposit contract
  • The property address
  •  The company’s registered address
